Car Accident Questions

Hello r/legaladvice,

I was recently involved in a car accident here in Colorado. I lost memory of the actual crash but woke up in an ambulance and was told that I ran a stop sign. It was on a county road where only my side of the street had a stop sign. I went back to the scene to see why I would do that and there is a tree hanging over the road to the right where the car that hit me came from. I can only guess that I had creeped into the intersection to see down the road for oncoming traffic and that's when we were hit. I'm told the vehicle I was in, Nissan Armada 2006 was hit by a jeep wrangler going 50 mph and flipped in the air and landed upside down on the other side of the road into a ditch. I had to be pulled out with the jaws of life. After being released from the hospital the same day with a concussion and misdiagnosis of my injuries, I had to go back to the ER and stay in hospital for another 5 days due to infections building up on my wounds but that's not relevant to my question.

I am being charged with reckless driving and failure to yield to a stop sign and driving without insurance (which I have since proven I did have insurance at that time, so that charge was dropped). I don't take the county roads unless I'm planning on driving slowly back home, my SO and I were taking pictures of the scenery this particular day and I know that I typically drive 10 miles under the speed limit on these roads since they are usually empty. My car was taken within a day and sent to a junkyard to be crushed almost immediately. The other party wasn't injured enough to warrant an ambulance, they just got in their car and had their wife drive them to the nearest hospital. I went to court for this recently and decided to postpone to ask for legal advice on whether I should get an attorney to fight these charges.

So that's my question - should I fight these charges? It's a potential combined fine of $2000 and/or two years in jail + whatever the other party involved decides to ask for in restitution and 8 points on my license. I don't feel these are fair as I was the one who was injured the most and this accident was potentially caused by a tree on county property that was not trimmed appropriately to allow for proper visage of the road. My SO and I have fractured ribs and I a fractured sternum that's going to take me a long time to recover from. I lost my vehicle and the other party's vehicle was barely damaged. I just don't think I'm being treated fairly over this whole situation, but that's what I'm here to find out if anybody would care to chime in, I appreciate the feedback. Thank you!
