Pregnancy Discrimination?
Is this pregnancy discrimination and do you have any suggestions for me?— I am a sales rep who lives in NY state and the company is headquartered in OH. I have been at the company for almost 5 years, I am 25 weeks pregnant, due in April and let my manager know in October that I was pregnant and my manager let HR know in October as well. On 12/6 I was put on a PIP plan and it’s a 90 day plan so the end date is 3/6. I am under my quota this year, (a long with others) and also important to note that this isn’t the first time I’ve been under quota (but my company has also not released any new products in 2 years and have had multiple product recalls as well). This was never an issue in the past and now all of a sudden it is? I wasn’t given much warning or coaching aside from being told by my manager that I need to do more overnight stays but nothing in writing, which I started doing more overnights and then skipped a month due to morning sickness which my manager is aware of. The timing seems curious IMO and I thought I was in more of a protected class being pregnant. I did meet with an employment attorney who seemed to think I definitely have a few claims here but really need to see if other sales reps are being treated differently so I can prove discrimination. He also said in this situation I cannot really be proactive since the PIP plan doesn’t end until 3/6 and I don’t know what will happen. Should I be asking more questions to my manager or HR as to why this came with no warning or just sit tight until 3/6? The attorney said that really depends on my end goal. My goal is to make it to maternity leave and spend that time looking for a new job so I can have pay during my leave period and health insurance for delivery. Looking for any suggestions and thank you in advance.
